9. Arbitration and Class Action Waiver Agreement
9.1 Arbitration
By using or purchasing DB6 products or services, you agree that any dispute, claim, or controversy (“Claim”) related to:
(a) these Terms or a breach thereof;
(b) your use of our website, services, or materials;
(c) any violation of Indian laws or regulations;
shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
Arbitration is a private dispute resolution method where a neutral third party (the arbitrator) delivers a binding decision. The arbitrator will provide a written statement of decision. Legal errors may be challenged in accordance with Indian law.
9.2 Arbitration Procedures
- The arbitration shall be conducted by a sole arbitrator appointed mutually.
- The arbitration proceedings shall take place in Ahmedabad, Gujarat, unless agreed otherwise.
- The proceedings will be conducted in Hindi/Gujarati/English and governed by Indian law.
- Both parties will bear their own legal and expert costs, unless otherwise decided by the arbitrator.
9.3 Exclusion from Arbitration
You may choose to opt out of this arbitration clause within 30 days of your first purchase by sending written notice to https://db6.in/policies/contact-information, stating:
- Your full name
- Your address
- A clear statement that you wish to opt out of arbitration
Timely receipt is your responsibility. If no valid opt-out is received, arbitration will apply.
10. Class Action Waiver
You agree to resolve disputes only in your individual capacity. You may not act as a plaintiff or class member in any collective or representative legal action. Arbitrators are not authorized to consolidate claims or conduct class proceedings.
Any dispute regarding this class action waiver’s enforceability will be decided by a court of competent jurisdiction in India.
